Last year, then Rep. Wesley Bishop introduced legislation that would have allowed the Orleans Parish School System to survey students about their "risk behavior...including those related to sexual health;" but, the bill did not pass.
At that time, we presented that Act 837 (which we drafted and which passed in the 2014 legislative session) prevents school officials from requiring the collection of certain information from our children. In fact, the only way that this "certain information" may be collected is if it is "voluntarily disclosed by the parent or guardian." This "certain information" specifically includes "sexual behavior or attitudes."
The fact that some children attend public schools should not make them subject to the violation of their right to privacy or the violation of any other rights...period.
The legislature is correct when it acknowledges in statute that state agencies have no authority to violate citizen's rights. When they attempt to change those same statutes in order to allow certain agencies to violate our rights, it is time for us to stand up.
The constitution is clear:
"Every person shall be secure in his person, property, communications, houses, papers, and effects against unreasonable searches, seizures, or invasions of privacy."
Senate Ed. Committee will meet upon adjournment of the Senate today. Since the Senate will not begin meeting until 3 P.M. today, there is time to act.
Please contact the Senate Education Committee and your Senators and ask them to vote no to SB218 and ask your contacts to do the same:
